This Data Protection Policy regulates the processing of personal data provided by the Data Subject through the website (hereinafter, the “Website“). By accepting this Privacy Policy, the data subject (hereinafter, the “Data Subject“) gives his or her informed, express, voluntary and clear consent to the processing of personal data collected through the Website, either through forms provided for this purpose or through information collected through cookies.

The Interested Party guarantees that the data provided are true, accurate, complete and up to date, and shall be liable for any direct or indirect damage or harm that may be caused as a result of non-compliance with this obligation. If you place a professional order with us, the legitimate purposes of the processing of personal data will be professional, administrative, accounting and tax management, as well as the filing of files.

We will keep them for as long as they are needed to manage the contact, consultation or order made.

To have your curriculum vitae to participate in our personnel selection processes. We will keep it during the development of the open personnel selection processes and for 1 year for future processes.

Data provided by subscribing to our Newsletter:

Sending of our commercial newsletter and informative and advertising communications about our products or services that are of interest to you within the scope of telephone marketing and sales techniques.

Whenever we make any communication of this type, it will be addressed solely and exclusively to those users who have previously and expressly authorised to receive them.

In accordance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, in the event that the user wishes to stop receiving commercial or promotional communications from MARKTEL, he/she may request cancellation of the service by sending an email to the following email address:, or by means of the link provided for this purpose in the communications themselves.

Data provided by means of the Contact Form:

To provide a means for you to contact us and answer your requests for information, as well as to send you communications about our products, services and activities within the scope of telephone marketing and sales techniques, including by electronic means (email, SMS, WhatsApp), if you tick the acceptance box.

Data provided through the Complaints Channel.

The personal data that you have provided to us in connection with complaints and enquiries via the Complaints Channel will be collected with the commitment to treat them as strictly confidential. This personal data will be processed for legitimate and specific purposes in relation to the investigation or management that may arise as a result of the complaint, irregularities and with the aim of providing answers, as well as defining the responsibilities that, where appropriate, may arise from the reported facts.

Likewise, this data will not be used for incompatible purposes and will be appropriate and not excessive in relation to the aforementioned purposes.


How long will we keep your data?

The data will be kept for the minimum time necessary to satisfy the purpose for which it was provided, as well as to meet the responsibilities that may arise from the data provided and any other legal requirement. Likewise, they will be kept blocked during the period of prescription of the legal actions derived from the aforementioned request.

The personal data provided through the Whistleblowing Channel Platform will be processed for the time necessary to decide whether to initiate an investigation into the reported facts, i.e. within a maximum period of three months from receipt of the communication, except in cases of particular complexity, in which case it may be extended for a further three months. On the other hand, if it is agreed to initiate the relevant investigation, the said data shall be processed for the entire duration of the investigation (including judicial proceedings, if applicable).

Once the aforementioned period has elapsed without any investigation having been initiated, the data shall be deleted or anonymised, unless there are legal provisions, in order to maintain evidence of the operation of the system and in an anonymised form.

Communications that have not been followed up may be recorded in anonymised form, completely deleting the personal data, without the obligation to block provided for in article 32 of Organic Law 3/2018, of 5 December, being applicable.


What is the legal basis for processing your data?

The legal basis for the processing of your data lies in the consent of the Data Subject (art. 6.1.a) RGPD.
The legal basis for the processing of your personal data is the informed, express, free and unambiguous consent that you give by accepting this Privacy Policy before sending/providing us with your data. In order for MARKTEL to comply with its legal obligations (tax, labour, Social Security, Occupational Risk Prevention, the duty to inform the judicial authorities, security, etc.) it will communicate the personal data required in the different procedures that are carried out before the corresponding bodies and entities (Courts, Tax Agency, General Treasury of the Social Security, National Employment Institute, Occupational Risk Prevention Service, Employers’ Mutual Insurance Company for Accidents at Work, judicial and police authorities, among others).

All this to avoid its alteration, loss, and/or unauthorised processing or access, as required by law, although absolute security does not exist.

Likewise, MARKTEL informs you that all our staff, whatever the phase of the processing in which they intervene, have adopted the commitment to treat your data with the utmost care and confidentiality.

However, the user should bear in mind that security measures on the Internet, due to their nature and global nature, are not impregnable.


What are your rights when you provide us with your data?

Users have the right to obtain confirmation as to whether MARKTEL processes personal data concerning them, as well as to access their personal data, request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
